These Terms & Conditions (“Terms”) govern your use of the RunToDrive application and this website (together, the “App”), provided by Lluís Armengol (“we”, “us”). By downloading or using the App you agree to these Terms. If you don't agree, please don't use the App.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, in accordance with the Apple Media Services Terms and Apple's Licensed Application End User Licence Agreement (EULA), which apply to your download.

You agree not to:

• Copy, modify, reverse-engineer, decompile or create derivative works of the App, except where that restriction is prohibited by law
• Rent, lease, sell, sublicense or redistribute the App
• Falsify workout, health or location data, or use automated means, modified hardware or software to generate progression you did not earn
• Use the App to break any law, or to interfere with its security or normal operation

2. Health, fitness and safety

RunToDrive is entertainment software. It is not a medical device and does not provide medical, diagnostic, therapeutic or professional coaching advice. Nothing in the App should be treated as a training prescription.

Physical exercise carries risk of injury. Consult a qualified healthcare professional before starting or significantly changing an exercise programme, particularly if you have a medical condition. Stop exercising if you feel unwell. You are solely responsible for your own safety, and you exercise at your own risk.

Never use the App in a way that distracts you from your surroundings. Do not interact with your device while cycling, crossing roads, or in traffic. Obey all local laws and pay attention to where you are going.

The in-game energy and recovery systems are game mechanics designed to discourage overtraining. They are not an assessment of your actual physical condition and must not be relied on as one.

3. Accuracy of data

Distance, pace, energy, heart rate and GPS measurements originate from your device, Apple Health and third-party apps. They are estimates and may be inaccurate. We make no warranty as to the accuracy of any metric shown in the App, or of any progression derived from it.

4. Accounts

You may use the App without an account. If you create one, you are responsible for keeping your credentials secure and for activity that occurs under your account. Provide accurate information and notify us of any unauthorised use. We may suspend or terminate accounts that violate these Terms — in particular, accounts that falsify activity data.

Creating an account backs your career up to our servers so it can be restored on a reinstall or a new device. The backup is a convenience, not a guarantee: it is written periodically, so a save may lag your most recent play, and we do not warrant that it will always be available or restorable (see section 10). The copy on your device remains the one the game runs from — keep in mind that deleting the App without an account deletes your progress with it. What the backup contains, and how it is protected, is described in our Privacy Policy.

You can delete your account at any time in the App under Account → Delete Account. This permanently deletes the account and its cloud backup; progress on your device is unaffected.

5. Purchases

RunToDrive is sold as a one-time purchase. There are no subscriptions, no premium currencies and no loot boxes. All purchases are processed by Apple and are subject to Apple's terms; refunds are handled by Apple, not by us. Any future paid content will expand the experience and will never sell progression that real-world effort is meant to earn.

6. In-game content

Cars, upgrades, points, XP, levels and other virtual items have no monetary value, cannot be exchanged for money, and are licensed to you rather than owned by you. We may adjust game balance, rules and content — including conversion rates and progression systems — as the game evolves. We'll try to preserve earned progress, but we cannot guarantee that any specific virtual item, balance or feature will remain available indefinitely.

7. Your content and feedback

If you send us feedback, suggestions or ideas, you grant us a perpetual, worldwide, royalty-free licence to use them to improve the App, without obligation or compensation to you. Please don't send us anything you consider confidential.

8. Intellectual property

The App, including its code, design, artwork, 3D models, text and the RunToDrive name and logo, is owned by us and protected by copyright and other laws. These Terms grant you no rights to our trademarks or branding.

9. Availability

The App is designed to work offline, but online features (account sync, backup, leaderboards) depend on third-party services and may be unavailable, changed or discontinued. We may modify or discontinue the App or any feature at any time.

10. Disclaimer of warranties

The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will be uninterrupted, error-free or that data will never be lost.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of data, profits or goodwill, arising from your use of the App — including any personal injury resulting from physical activity undertaken while using it. Our total liability is limited to the amount you paid for the App.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all statutory rights that cannot be waived.

12. Termination

You may stop using the App at any time by deleting it. We may suspend or terminate your access if you breach these Terms. Sections 6 through 11 survive termination.

13. Apple

Apple is not a party to these Terms and has no obligation to provide support or maintenance for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you. Any claim that the App fails to conform to a warranty may be directed to Apple for a refund of the purchase price.

14. Governing law

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. If you are a consumer resident in the EEA or UK, you retain the protection of the mandatory laws of your country of residence and may bring proceedings there.

15. Changes

We may update these Terms. The “last updated” date above will change, and material changes will be announced in the App. Continuing to use the App after an update means you accept the revised Terms.
